Equipment Rental Terms & Conditions

1. Introduction & Role of Green Gooding

These Equipment Rental Terms and Conditions ("Agreement") govern the rental of equipment, tools, and small appliances ("Equipment") facilitated through the Green Gooding platform ("Green Gooding," "we," "us," or "our").

Green Gooding operates as a marketplace platform that connects renters ("Renter" or "you") with independent equipment owners, which may include local businesses or individual owners ("Owner"). By placing a rental order through Green Gooding, you agree to be bound by this Agreement.

2. Rental Period & Condition of Equipment

The Equipment is provided "as is" for the rental period selected at checkout ("Rental Period"). Owners are responsible for making reasonable efforts to ensure that Equipment is:

  • Clean
  • Functional
  • Suitable for its intended, customary use

You agree to inspect the Equipment at pickup and notify the Owner or Green Gooding immediately if there is an issue. Continued use constitutes acceptance.

3. Payment, Fees & Authorization

You agree to pay all rental charges displayed at checkout, including:

  • Rental price
  • Late fees (if applicable)
  • Cleaning or damage fees (if applicable)

Payment is processed through Green Gooding's approved payment provider. By completing a rental, you authorize Green Gooding to charge your payment method for all amounts due under this Agreement.

4. Permitted Use & Renter Responsibilities

You agree that you will:

  1. Use the Equipment only for its intended, customary purpose
  2. Follow all safety, operating, and usage instructions
  3. Not misuse, abuse, alter, sublease, or transfer the Equipment
  4. Keep the Equipment secure and under your control
  5. Not use the Equipment while impaired
  6. Comply with all applicable laws and regulations
  7. Immediately stop using the Equipment if it becomes unsafe or damaged

You are responsible for the Equipment from pickup until return.

5. Return of Equipment

You agree to return the Equipment:

  • On time
  • To the designated return location
  • In substantially the same condition as received (reasonable wear excepted)

Late returns may result in:

  • Additional rental charges
  • Late fees
  • Loss of access to the platform

Failure to return Equipment may result in further charges and account suspension.

6. Damage, Loss & Optional Protection

6.1 Responsibility for Damage or Loss

You are responsible for:

  • Loss
  • Theft
  • Damage beyond normal wear and tear

Charges may include:

  • Repair or replacement cost (not to exceed fair market value)
  • Cleaning fees
  • Administrative processing fees

6.2 Protection Plans

Green Gooding offers damage protection at checkout.

  • Damage protection covers accidental damage during normal use
  • It does not cover loss, theft, misuse, negligence, or intentional damage
  • Damage protection is not insurance

7. Cancellations & Modifications

Cancellation and modification policies are displayed at checkout and may vary by item or Owner.

Late cancellations (24 hours before rental) may result in partial or full charges.

8. Platform Role & Limitation of Liability

Green Gooding:

  • Facilitates bookings and payments
  • Is not responsible for how Equipment is used
  • Is not liable for injuries, damages, or losses arising from use of Equipment, except to the extent required by law

To the maximum extent permitted by law, Green Gooding's liability is limited to the amount paid for the rental.

9. Indemnification

You agree to indemnify and hold harmless Green Gooding, its officers, employees, and partners from claims arising out of:

  • Your use of the Equipment
  • Your breach of this Agreement
  • Damage or injury caused during the rental period

10. Termination & Account Restrictions

Green Gooding may suspend or terminate your account if you:

  • Fail to return Equipment
  • Damage Equipment repeatedly
  • Violate these Terms
  • Engage in fraudulent or abusive behavior

11. Governing Law

This Agreement is governed by the laws of the State of New York, without regard to conflict-of-law principles.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the platform constitutes acceptance of the updated Terms.

1. Introduction & Role of Green Gooding

These Equipment Owner Terms and Conditions ("Agreement") govern the listing and rental of equipment, tools, and small appliances ("Equipment") through the Green Gooding platform ("Green Gooding," "we," "us," or "our").

Green Gooding operates as a marketplace platform that connects independent equipment owners ("Owner" or "you") with renters ("Renter").

Green Gooding facilitates:

  • Listings
  • Bookings
  • Payment processing

Green Gooding does not own the Equipment listed on the platform (unless explicitly stated). By listing Equipment on Green Gooding, you agree to be bound by this Agreement.

2. Eligibility & Account Requirements

To list Equipment, you must:

  • Be at least 18 years old
  • Have the legal right to rent the Equipment
  • Provide accurate identification and payment details
  • Connect a valid payout account through Green Gooding's payment provider (e.g., Stripe Connect)

You are responsible for keeping your account information accurate and up to date.

3. Listings & Equipment Standards

You agree that all listed Equipment must be:

  • Clean
  • Functional
  • Safe to operate
  • Suitable for its intended, customary use

You must provide:

  • Accurate descriptions
  • Clear photos
  • Any relevant operating or safety instructions

Green Gooding may remove listings that are unsafe, misleading, or violate platform standards.

4. Pricing, Fees & Payouts

4.1 Rental Pricing

You set the rental price unless otherwise agreed with Green Gooding.

4.2 Platform Fee

Green Gooding retains a service fee from each completed rental.

Owners receive 80% of the rental price.

Additional service fees may apply for optional services (e.g., insurance, featured listings).

4.3 Payment Processing

Payments are processed through Green Gooding's approved payment provider.

4.4 Payout Timing

Owner payouts are issued after the rental period is completed, minus applicable platform and processing fees.

Green Gooding may temporarily hold payouts in cases of:

  • Reported damage
  • Disputes
  • Suspected fraud

5. Owner Responsibilities

You agree that you will:

  1. Ensure Equipment is safe and in good working condition
  2. Disclose known defects or limitations
  3. Provide clear pickup and return instructions
  4. Comply with all applicable laws and regulations
  5. Not list stolen or unauthorized Equipment
  6. Maintain appropriate insurance coverage if required

You remain the legal owner of the Equipment at all times.

6. Damage, Loss & Protection

6.1 Renter Responsibility

Renters are responsible for damage or loss occurring during the rental period, subject to the Renter Terms and any selected protection plan.

6.2 Damage Protection

Green Gooding offers owners damage protection for up to 50% of the value of the item new (as declared in listing).

Damage protection:

  • Covers accidental damage during normal use
  • Is not an insurance covering injuries to people or damage to goods or properties

Green Gooding does not guarantee full recovery of losses.

6.3 Claims Process

Owners must report damage or loss within a reasonable timeframe (within 24 hours) after return and provide documentation (photos, repair estimates, receipts).

7. Cancellations

Cancellation policies may vary by listing.

Green Gooding may issue refunds to renters according to platform policy. Owner payouts may be adjusted accordingly.

Repeated last-minute cancellations by Owners may result in reduced visibility or account suspension.

8. Platform Role & Limitation of Liability

Green Gooding:

  • Facilitates bookings and payments
  • Does not take possession of Equipment (unless otherwise specified)
  • Does not supervise rentals
  • Does not guarantee renter behavior

To the maximum extent permitted by law:

Green Gooding is not liable for:

  • Damage, theft, or loss of Equipment
  • Personal injury arising from Equipment use
  • Indirect or consequential damages

Green Gooding's liability is limited to the total service fees collected for the relevant rental.

9. Tax Responsibilities

Owners are responsible for:

  • Reporting rental income
  • Paying any applicable taxes (varies from state to state)
  • Complying with local business or licensing requirements

Green Gooding may issue required tax forms where applicable.

10. Termination & Account Restrictions

Green Gooding may suspend or terminate your account if you:

  • Provide unsafe Equipment
  • Misrepresent listings
  • Engage in fraudulent activity
  • Violate these Terms
  • Repeatedly cancel confirmed rentals

You may remove your listings at any time, subject to existing bookings.

11. Governing Law

This Agreement is governed by the laws of the State of New York, without regard to conflict-of-law principles.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the platform constitutes acceptance of the updated Terms.
